Workers' Compensation
If an Oregon subject worker is injured during his or her work day, he or she may be able to recover medical services, time loss, permanent partial disability and vocational retraining.
Filing a Claim:In an Oregon Workers' Compensation claim, the claim must be filed within 90 days, if an injury occurs. If you have a occupational disease claim, you must file within one year of learning about the injury. To file a claim, ask your employer for an 801 form. Denial:The workers' compensation insurance company, or claims processing company, has 60 days to accept or deny your claim. If you do not have a letter within 60 days accepting or denying your claim, contact Welch, Bruun & Green at (503)221-0870 or email us at workerscomp@wbgatty.com. If, however, you receive a denial from the insurance or claims processing company, you have 60 days to appeal the denial. Acceptance of a Claim:Often in a workers' compensation claim, the insurance company will attempt to minimize your claim by accepting a small injury. Do not allow the insurance company to play down your claim. Notice of Closure:In an Oregon workers' compensation claim, as you reach the close of your treatment you will be deemed "medically stationary." At that point, the insurance company will move your claim towards "claim closure". In some cases, you may be entitled to a significant permanent partial disability award for your injury. If you have received a Notice of Closure, you have 60 days to request reconsideration of the Notice of Closure. Benefits in an Oregon Workers' Compensation claim:There are only four benefits you can recover in an Oregon workers' compensation claim. The four benefits are: Time Loss, Medical Services, Permanent Partial Disability and Vocational Retraining.
Time Loss:The insurance company must pay you 2/3 of your weekly salary. To come to this figure, the insurance company generally examines your average weekly salary over the past 52 weeks.
